Freedom of contract versus mandatory law – challenges when leading employees –
role of the works council

Labour law in Germany is rather different from the labour law in other countries, especially in the UK, the United States and in Asia. In the first part, the seminar introduces foreign managers to the concept of labour law which is, on the one hand, economic law based on the idea of freedom of contract and on the other hand maintains a high level of employee protection. This becomes evident by the number of mandatory legislation which delegates conceptual power to collective law, i.e. tariff agreements or collective agreements. The second part of the seminar deals with the challenges of leading employees in every day working life. This includes questions concerning the employer´s discretionary right and remote working as well as how to approach performance issues such as will, ill and skill. Whenever appropriate, you will be familiarised with the role and the rights and obligations of the works council on the subject of co-determination.
